Terms and Conditions

 

Thank you for allowing DeLoach Sotheby’s International Realty (DSIR) to assist you with your vacation accommodations. DSIR offers office hours Monday through Friday 9:00 A.M. to 5:00 P.M. and is located at 2901 Frederica Road, St. Simons Island. A 24 hour answering service is available for after hours requests. Following are our policies and procedures.

CHECK IN
Time: Check in is a 4:00 P.M. and Check out is at 10:00 A.M.
Where: DeLoach Sotheby’s International Realty, 2901 Frederica Rd., St. Simons Island, GA.
After Hours: Please refer to your rental confirmation for after hours check in procedures or contact our office at 912-638-0406.

RESERVATION TERMS: GUEST will provide a valid credit card and a deposit equal to 50% of total reservation at time of reservation. Rental balance is due upon arrival and the card on file will be charged without notice unless prior arrangements have been made. Any reservation made within 30 days of arrival will be due in full at time of booking. Balance can be paid by check, cash, money order, VISA, Master Card or American Express. Any balances unpaid by departure will be automatically charged to the credit card on file without notice. GUEST will be charged rental rate and applicable sales tax, cleaning fees and any extra options chosen by GUEST. Rental rates are subject to change at any time prior to confirmation.

CANCELLATION POLICY: There is a $50.00 fee on all cancellations. Deposits will be refunded 100%, less cancellation fee, if reservation is cancelled 30 days or more prior to scheduled arrival date. No refunds for cancellations with 30 days of arrival date or with no notice.

PROCESSING FEE: A processing fee of $50.00 is charged to cover reservation expenses on all reservations.

TAXES: Georgia State Sales Tax of 7% applies to all vacation rentals for the length of the stay. In addition, a Glynn County Hotel-Motel Tax of 5% is charged on the first 30 days of all vacation rentals.

PROPERTY AMENITIES: All Cottages are fully furnished, equipped and maintained according to Owner preference and are subject to DSIR requirements. Linens are included. A starter supply of paper products and garbage bags are provided. GUESTS will be responsible for replenishing these items during their stay. Many of our Cottages have private pools and other additional amenities. All charges for natural gas or electricity which is used to heat pool whether outdoor or indoor will incur an additional charge. PERMITTED OCCUPANCY: GUEST agrees that the number of persons occupying the cottage under this agreement will be the lesser of the Maximum Occupancy or the number of GUESTS as stated on the confirmation.

SMOKING: All Cottages are NON-SMOKING. GUEST has agreed to NO SMOKING for the duration of the reservation. Non-compliance with this rule will result in a $500 fine and DSIR reserves the right to terminate the Rental Agreement and GUEST will be required to vacate the Cottage immediately without refund.

PETS: A limited number of pet friendly properties are available. All pets must be approved in advance and a non-refundable $300 pet fee is required at time of reservation. GUEST will provide a valid credit card and authorizes DSIR to charge any and all damages caused by pet. If GUEST is occupying a Cottage that is not pet friendly or if DSIR has not approved the pet in advance DSIR reserves the right to terminate this Agreement and GUEST will be required to vacate the Cottage immediately without refund. A fee of $500 will be charged for each unauthorized pet found on the premises.

SECURITY DEPOSIT: GUEST will provide a valid credit card and authorizes DSIR to charge this credit card for any and all damages, extraordinary cleaning charges, lock out expenses, key charges, missing items, laundry service or any Extra Options chosen by GUEST or any other Sea Island Resort charges incurred by GUEST during their stay unpaid at departure. Unintentional damage must be reported by the GUEST prior to departure. This card and authorization shall be kept on file for 30 days after GUEST check out. No refunds for eviction, early departure or inclement weather (unless GEMA orders a mandatory evacuation). Any key not returned to DSIR will result in a $25.00 per key charge that will be billed to the credit card on file.

AGE REQUIREMENTS: One individual in each party must be at least 25 years of age and must occupy the Cottage during the entire stay. Non-compliance may result in termination of this Agreement and GUEST will be required to vacate the Cottage immediately without refund.

DAMAGES TO YOUR PERSONAL PROPERTY: GUEST agrees to hold harmless OWNER or DSIR for any damages to your personal property or for any accident that may occur to you or those in your party during your occupancy, in or on the property or any articles left in the property. GUEST agrees to pay shipping costs for any items left behind they would like returned.

REFUNDS: There will be no refunds issued for interruption of utilities, early departure (unless otherwise noted), inclement weather, eviction, or mechanical malfunctions. During your stay please report any damages, malfunctions or problems immediately to DeLoach Sotheby’s International Realty at 912-638-0406. Complaints made after departure will not result in discounts or refunds. We will make every effort to ensure that repairs are made in a timely manner and any issues are resolved as quickly as possible.

BEHAVIOR: Loud and disruptive behavior will not be tolerated and will result in eviction without refund.

SUBSTITUTION: DSIR strives to honor all reservation requests for every GUEST. However, due to ownership changes, unforeseen mechanical malfunctions or other circumstances that are outside of our control, DSIR reserves the right to move the GUEST to another comparable cottage. DSIR will contact the GUEST in advance of or upon arrival of the change. If the GUEST is not satisfies with the substitution the GUEST will have the option of selecting from other available cottages the paying published rate, or a full refund.

RENTAL EMERGENCIES: DSIR offers a 24 hour answering service that can assist you with requests or emergencies. Please limit after hours calls to emergencies that could cause harm to the cottage or GUEST if not repaired immediately. Otherwise, report interruption in cable service, internet, minor repairs or malfunction of luxury amenities during business hours. For medical or any other life threatening emergency please call 911.

UTILITIES: Cottage rental rates are inclusive of utilities unless otherwise noted. If there is an interruption in utilities DSIR will make every effort to resolve such interruptions as quickly as possible. Reservations that exceed 30 days in duration, are subject to a surcharge if utilities are significantly higher than average during their occupancy.

Temporary Membership and Sea Island Resort Charges (for Guests of Sea Island Members Only): GUEST will provide a valid credit card to Sea Island Resorts and agrees to allow Sea Island Resorts to charge this card for Temporary Membership and for all Sea Island Resort charges incurred by GUEST or members of GUEST’s household. GUEST shall comply with all Sea Island Resort dress codes.

DEPARTURE: Please place any soiled linens in the laundry area and return all keys to DSIR or predetermined drop off location.

MAIL, FAX & INTERNET SERVICE: Our office is available to all GUESTS for mail pick-up, fax machine, and Internet service during regular business hours at no charge.

OWNERS’ AGENT: Under Georgia State law, renters are hereby advised that DSIR is acting solely as the owners’ agent and have without limitation the following fiduciary duties to owner: undivided loyalty, confidentiality, full disclosure, obedience and a duty to account.
